These Terms of Service ("Terms") govern your use of the Vlogly iOS application and website operated by Liam O'Connor (trading as Vlogly) ("we", "us", or "our"). By downloading, accessing, or using Vlogly, you agree to these Terms. If you do not agree, do not use the service.
1. About Vlogly
Vlogly is an iOS application that helps friend groups capture travel memories and automatically generates cinematic recap videos. Vlogly is a private memory tool for your group — not a social network. Your trip content is visible only to members you invite.
2. Eligibility
You must be at least 13 years old to use Vlogly. By using the service, you represent that you meet this requirement and have the legal capacity to enter into these Terms. If you are under 18, you confirm you have permission from a parent or guardian.
3. Your account
You create an account using your email address or Apple Sign-In. You are responsible for maintaining the security of your account and for all activity under your account. Notify us immediately at support@vlogly.app if you suspect unauthorised access.
4. Acceptable use
You agree not to:
- Upload content that is illegal, harmful, threatening, abusive, or infringes others' rights
- Harass, bully, or harm other users
- Attempt to access other users' accounts or trip data without authorisation
- Reverse engineer, decompile, or attempt to extract source code from the app
- Use automated systems to access the service without our permission
- Use Vlogly for commercial purposes without our written consent
5. Your content
You retain ownership of the video clips and content you upload. By uploading content, you grant us a limited, non-exclusive licence to store, process, and display your content solely to provide the Vlogly service — including generating recap videos and sharing within your trip group.
You represent that you have the right to upload all content you share and that it does not infringe any third party's intellectual property or privacy rights. You are responsible for obtaining consent from people who appear in your clips.
6. Trip privacy
Trip content is visible only to members you invite. You are responsible for who you invite to your trips. We are not responsible for how trip members use or share content outside the app.
7. Recap videos
Recap videos are automatically generated from clips contributed by trip members. We do not guarantee specific quality, length, or content of recaps. Recap generation depends on the clips available and may vary. You can export and share recaps using the in-app share features.
8. Service availability
We strive to keep Vlogly available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where possible. We are not liable for temporary outages or maintenance.
9. Pricing and in-app purchases
Vlogly may offer free and paid features. Some trip capacity upgrades and add-ons are available as in-app purchases processed by Apple through the App Store. All purchases are subject to Apple's terms and refund policies.
Prices are displayed in the app before you confirm a purchase. We reserve the right to change pricing for future purchases with advance notice. Existing purchases are not retroactively affected unless required by law.
10. Intellectual property
Vlogly, including its design, features, branding, and recap generation technology, is owned by Liam O'Connor (trading as Vlogly). You may not copy, modify, or distribute our intellectual property without permission. Your uploaded content remains yours.
11. Disclaimer of warranties
Vlogly is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be error-free or meet your specific requirements.
12. Limitation of liability
To the maximum extent permitted by law, Liam O'Connor (trading as Vlogly) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of Vlogly, including loss of data or content. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or £0 if you have not made any purchases).
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or for fraud.
13. Indemnification
You agree to indemnify and hold us harmless against claims arising from your use of Vlogly, your content, or your violation of these Terms or applicable law.
14. Termination
You may delete your account at any time via Settings → Account → Delete Account in the app, or by following the instructions on our Delete Account page. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use Vlogly ceases immediately.
15. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
16. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes via the app or email. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use after changes constitutes acceptance.
